A prosecution witness said the two memoranda of understanding (MoU) signed between the Penang State Government and Beijing Urban Construction Group (BUCG) in 2011 did not state that the seabed tunnel project in the state would be implemented through an open tender.
On the other hand, former Penang Chief Minister Lim Guan Eng says it was repeatedly said of open tender.
In addition to the China company BUCG, also Zenith Bejing Urban Construction Group Sdn. Bhd. (CZBUCG) which is a joint venture company with BUCG mentioned in corruption case.
The court is hearing the trial of Guan Eng, 60, as a Chief Minister accepting a bribe of RM3.3 million as an action to help a company be appointed to implement a project worth RM6.3 billion.
