Romania national road company CNAIR rejects the only bid for r lot 2 Lugoj - Deva with 2,13km tunnel

    The National Company for Road Infrastructure Management (CNAIR) has just rejected the only bid it had received for the Lugoj-Deva Highway (A1), Lot 2 work. So called the "missing link" with 2,13km long tunnel remains without a contractor.

    This 300 million euro section tender deadline originally was 31 January. But there was appeal of Greek company Aktor. It was rejected on January 26. And before the new tender deadline of 14 February, only one bidder, a consortium of Mapa Insaat ve Ticaret AS - Cengiz Insaat Sanayi ve Ticaret AS had submitted a bid.

    CNAIR has said in a release (below) that the technical offer submitted was not compliant with the the tender. Before the tender, interested companies had submitted over 130 questions for CNAIR to clarify. In other words, there were many points that needed to be clarified in the technical specifications according to the potential contractors. Probably the reason why they did not submit their bids, because they were not satisfied with CNAIR specifications. On the other hand, it is probable that the Turkish consortium tried to solve the alleged vague specification situation by specifying constraints in their technical offer which were not accepted by CNAIR.

    On Thursday, 10.03.2022, CNAIR announces that it will resume the tender for the contract for “Design and execution of works for the major investment objective Lugoj – Deva Highway (A1), Lot 2: km 27 + 620 - km 56 + 220 - Section E and completion Section D ”because the technical offer submitted by CONSORTIUM OF MAPA INSAAT VE TICARET AS - CENGIZ INSAAT SANAYI VE TICARET A.S. (Turkey) is non-compliant.

    Following the evaluation process, CNAIR found that the technical proposal submitted by the Turkish association was non-compliant, based on the applicable legal provisions in the field of public procurement.

    As the only tender submitted in the award procedure was rejected, CNAIR as the Contracting Authority canceled the award procedure, in accordance with the provisions of art. 212 para. (1) lit. a) of Law no. 98/2016 on public procurement:

    1. The contracting authority has the obligation to cancel the procedure for the award of the public procurement contract / framework agreement in the following cases:

    a) if no offer / request for participation has been submitted or if no admissible offer has been submitted;

    As a matter of urgency, CNAIR will take all necessary steps to quickly resume the new award procedure for this contract.
