The wife of the injured tunnel worker Tyler Tompkins, a Salini Impregilo SPA Inc./The Lane Construction Corporation employee, files a lawsuit against the German tunnel boring machine manufacturer Herrenknecht and a contractor.
The lawsuit filed in Allen Superior Court says Herrenknecht Tunnelling Systems USA and Shambaugh & Son are liable for the accident when a pipe of the TBM exploded in Fort Wayne's Deep Rock Tunnel.
The April 16, 2020 accident had severely injured Tyler Tompkins, an employee of the complaint states that as a result of the TBM Mamajo pipe explosion, "highly pressurized slurry, as well as possibly piping and/or piping fragments," hit Mr Tompkins leaving him physically and mentally incapacitated.
The complaint says, the worker did not know that the equipment was defective.

I hope courts will stand behind the injured worker. I hope it will be a model trial for other countries such as India. Often when I hear workers are injured, the boss of the construction company pays a small amount and the worker is sent to his village. I hope this will change.

One of the defendants, the contractor Shambaugh and Son had waned the trial moved out of the Allen county arguing due to the extensive media coverage, it would be difficult to find jurors.
I read somewhere that the other defendant, the TBM manufacturer Herrenknecht has been neutral over any move, unlike the contractor. Respect for that!
